Terms of Use
Last updated November 1, 2026
Please read these Terms before using BoomLink Health or this website.
1. Agreement
These Terms of Use ("Terms") govern use of the BoomLink Health service and this website, provided by The Boom Company, Inc., doing business as Boom Logic ("Boom Logic", "we", "us"). By using them, you agree to these Terms. If you use BoomLink Health for a clinic or other organization, you agree on its behalf and confirm you have authority to do so. A signed order form or services agreement with your organization, if any, controls where it conflicts with these Terms.
2. The service
BoomLink Health lets clinic staff start temporary, secure conversations with patients. A patient receives a text with a link, confirms their date of birth, and can read, reply, download attachments and save the conversation. Links and conversations expire on a schedule. BoomLink Health is a messaging tool, not a medical record: the clinic is responsible for keeping what matters in its own records. Features described as "coming soon" are not part of the service until we make them available.
3. Not for emergencies
BoomLink Health is not for emergencies. If you or someone else needs urgent help, call 911 or go to the nearest emergency room. Messages may not be read right away, links expire, and texts can be delayed or fail to deliver.
4. Accounts
Staff accounts are for the named person only. Organizations are responsible for who they give access to, for the roles and locations they assign, and for removing access promptly when someone leaves. Keep sign-in methods secure and tell us right away about any unauthorized use.
5. Clinic responsibilities
- Get and record each patient's consent to receive texts, and honor opt-outs (for example, STOP replies).
- Make sure patient contact details are correct and that you send information to the right patient.
- Use the service in line with HIPAA, the TCPA and other laws that apply to you.
- Keep any information you need in your own EHR or records before a session expires.
- Tell patients the service is not for emergencies.
6. Acceptable use
You agree not to:
- send marketing, spam or messages to people who haven't agreed to receive them;
- send unlawful, harassing or harmful content, or malware;
- try to get around security, date-of-birth checks, rate limits or access controls;
- access data you aren't authorized to see, or probe, scan or overload the service;
- copy, resell or reverse-engineer the service except as the law allows.
We may suspend access to protect patients, clinics or the service.
7. Fees
Fees, billing terms and the agreement length are set in your order form. Prices on our website are for information and may change; your order form controls. Unless the order form says otherwise, fees are billed monthly in advance and are non-refundable, and taxes are extra.
8. Protected health information
Where we create, receive, maintain or transmit protected health information for a clinic, we do so as its business associate under a Business Associate Agreement. If these Terms conflict with the Business Associate Agreement about protected health information, the Business Associate Agreement controls.
9. Intellectual property
We own BoomLink Health, this website and their software, design and trademarks. We give your organization a limited, non-exclusive, non-transferable right to use the service during its agreement. Your organization owns its data and patient content; you give us permission to process it only to provide and support the service. If you send us feedback, we may use it without obligation.
10. Confidentiality
Each party will protect the other's confidential information with reasonable care and use it only for the purposes of the relationship, except where disclosure is required by law.
11. Disclaimers
Except as stated in a signed agreement, the service and website are provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the service will be uninterrupted or error-free, or that every text will be delivered. BoomLink Health does not provide medical advice.
12. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, and our total liability for any claim is limited to the fees your organization paid us in the 12 months before the claim. These limits don't apply where the law doesn't allow them, and the Business Associate Agreement may set different terms for protected health information.
13. Termination
Your organization's agreement sets its term and how it ends. We may suspend or end access for a material breach of these Terms that isn't fixed after notice, or right away if needed to protect patients or the service. When access ends, we handle remaining data as the order form and Business Associate Agreement require.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Courts in Los Angeles County, California have exclusive jurisdiction, unless a signed agreement says otherwise.
15. Changes
We may update these Terms. We'll change the "Last updated" date above and give notice of significant changes. Continuing to use the service after changes take effect means you accept them.
